ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1 The times permitted to sell alcohol do not prohibit or restrict the supply to, or consumption by, any person of alcohol in any premises, where the premises are bona fide used, or intended to be used, for the purpose of habitually providing for reward, board and lodging, including breakfast and at least one customary main meal.
2 The times permitted to sell alcohol do not prohibit or restrict the sale of alcohol to a trader for the purposes of their trade or to a club with a club premises certificate for the purposes of the club.
3 The times permitted to sell alcohol do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.
4 The times permitted to sell alcohol do not prohibit or restrict the taking of alcohol from the premises by a person residing there.
5 The times permitted to sell alcohol do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friend (s) of a person residing there who are bona fide entertained by them at their expense, or the consumption of persons so supplied.
6 The times permitted to sell alcohol do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
7 The times permitted to sell alcohol do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.
8 Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied:
(i) With and for the consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal;
(ii) For consumption by a person residing in the premises or his/her guest and paid for together with his/her accommodation;
(iii) To a canteen or mess.
9. The consumption of any alcohol supplied shall be consumed by the end of the first thirty minutes after the permitted hours for the sale of alcohol.
10. The taking of alcohol off the premises shall take place by the end of the first twenty minutes after the permitted hours, and shall be supplied or taken in a sealed container.
11. No person under fourteen shall be in the bar of the licensed premises during the permitted hours unless one of the following applies:-
(i) They are the child of the holder of the premises licence;
(ii) They reside in the premises, but are not employed there;
(iii) They are in the bar solely for the purpose of passing to or from some part of the premises, which is not a bar; and to or from, where there is no other convenient means of access or egress;
(iv) The bar is in premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of the licence is ancillary.
12. References in paragraph 11 above to “a bar” do not include a bar at any time when it is usual in the premises for it to be, and it is:
(i) Set apart for the service of table meals, and
(ii) Not used for the sale or supply of alcohol otherwise than to persons having table meals there and for consumption by such a person as an ancillary to their meal.
13. Suitable beverages other than intoxicating liquor (including drinking water) shall be equally available for consumption with or otherwise as an ancillary to meals served in the licensed premises.
14. There shall be afforded in the premises, for persons provided with a board and lodging for reward, adequate sitting accommodation in a room not used or to be used for sleeping accommodation, for the service of substantial refreshment or for the supply or consumption of intoxicating liquor.
