ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1 The times permitted to sell alcohol do not prohibit or restrict the supply to, or consumption by, any person of alcohol in any premises where the premises are bona fide used, or intended to be used, for the purpose of habitually providing for reward, board and lodging, including breakfast and at least one customary main meal.
2 The times permitted to sell alcohol do not prohibit or restrict the sale of alcohol to a trader for the purposes of their trade or to a club with a Club Premises Certificate for the purposes of the club.
3 The times permitted to sell alcohol do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.
4 The times permitted to sell alcohol do not prohibit or restrict the taking of alcohol from the premises by a person residing there.
5 The times permitted to sell alcohol do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.
6 The times permitted to sell alcohol do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
7 The times permitted to sell alcohol do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.
8 The times permitted do not prohibit or restrict, during the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel.
9 Children are not permitted in the ground floor restaurant/bar or lower ground floor function room unless meals and non-alcoholic beverages are available for sale for consumption in that area and, they are in the company of a person aged 18 or over and are there prior to 9 p.m 1st October to 31st March and 10 p.m. 1st April to 30th September. In such circumstances, they may remain in the specified area for thirty minutes after the certificate has ceased to have effect for the consumption of refreshments.
10 The premises may remain open for no more than 60 minutes after the end of the period during which the retail sale of alcohol is permitted.
11 The premises shall be a member of pub watch.
12 A person holding the National Licences Certificate shall be on the premises at all times when alcohol is being served or when regulated entertainment is provided.
13 An incident book and record details of all instances of public disorder shall be kept.
14 Free drinking water shall be made available at all times the premises is open to the public.
15 Seats shall be available to accommodate one third of the maximum capacity of the premises.
16 The maximum number of persons to be admitted to the premises at any one time for the purpose of public entertainment events shall not exceed 100 for the lower ground floor and 60 for the ground floor.
17 Door supervisors shall be correctly registered with the SIA.
18 Door supervisors shall display the correct name badge.
19 Door supervisors shall carry proof of registration.
20 Door supervisors shall be used at a ratio to be agreed by the police and Local Authority, which is currently 1:75.
21 Where there are 5 or more door supervisors, at least one of these shall be female.
22 Door supervisors shall wear clothing that can be easily and clearly identifiable on CCTV.
23 Door supervisors shall be in attendance at the entrance of the premises from 9pm until main exit doors to the premises are closed, and any time when patrons may be queuing for access.
24 CCTV shall be installed and working to the satisfaction of the Police and Local Authority.
25 Recordings shall be maintained for an appropriate periof of time (generally one month - but to be agreed with the Police and Local Authority).
26 if the CCTV equipment is inoperative immediate steps shall be taken to the equipement back into action.
27 A notice shall be displayed at the entrance to the premises advising that CCTV is in operation.
28 No customers carrying open or sealed bottles or glasses shall be admitted to premises at any time.
29 No customers shall be permited to take open containers to alcoholic or soft drinks from the premises.
30 All bottles and glasses shall be removed from public areas as soon as they are finished with or empty.
31 Radios shall be used in town centre licenced premises to provide two way communication between themselves, the Police and other licenced premises.
32 The equipment shall be kept in working order at all times.
33 The equipment shall be on at all times the premises are open to the public, and shall be monitored by the Designated Premises Supervisor or other responsible staff member.
34 All instances of crime and disorder shall be reported to the police via CCTV or the radio.
35 Any police requirements shall be complied with at all times.
36 A proof of age policy to the satisfaction of the police and the Local Authority shall be in place.
37 All-inclusive nights or other irresponsible drinks promotions shall not be permitted.
38 An anti drug policy agreed by the police and local authority shall be in force.
39 A secure facility to store controlled drugs shall be available.
40 There shall be no admission to the premies after Midnight on any day.
41 All exits doors shall be easily openable without the use of a key, card, code or similar means and shall be available for egress while the public are on the premies.
42 Means of escape shall be maintained unobstructed, immediately available and clearly identifiable.
43 Exit doors shall be regularly checked to ensure they function satisfactorily. Records of these checks will be kept and produced on request.
44 Any removable security fastenings shall be removed whenever the premises are open to the public or staff.
45 All fire doors shall be maintained effectively self-closing and shall not be held open other than by approved devices.
46 Fire resisting doors to service shafts, ducts and cupboards shall be kept locked shut.
47 Step and stair edges shall be highlighted so as to be conspicuous.
48 All floor coverings shall be secured and maintained so that they will not ruck. Mats shall be fitted into matwells, so as to be flush with the floor surface.
49 Hangings, curtains and temporary decorations shall not obstruct exits, fire safety signs or fire-fighting equipment.
50 Notices detailing the actions to be taken in the event of fire or other emergency shall be prominently displayed and maintained in good condition.
51 Access shall be provided for emergency vehicles and this access shall be kept clear and free from obstruction.
52 Fire drill and emergency lighting tests shall be conducted monthly. Records of these tests shall be made available to the Licensing Authority upon request.
53 All fire exits and means of escape shall be signed in accordance with BS5499.
54 An evacuation policy shall be in place that is to the satisfaction of the Fire Authority. All staff members shall be trained in the evacuation policy; and what to do in the event of a fire.
55 The fire brigade shall be called to any outbreak of fire.
56 Wall and ceiling finishes shall be fire resistant.
57 Exit doors shall open outwards (or will be secured in the open position).
58 When disabled people are present, adequate arrangements shall exist to enable their safe evacuation in the event of an emergency.
59 Adequate and appropriate supply of first aid equipement and materials shall be available on the premises.
60 At least on suitable trained first aider shall be on duty when the public are present.
61 Fire safety signs shall be adequatley illuminated.
62 Emergency lighting shall not be altered.
63 Emmergency lighting batteries shall be fully charged before the admission of the public.
64 In the event of failure of normal lighting, where the emergency lighting battery has a capacity of one hour, evacuation of the premises shall be possible within 20 minutes.
65 Where the emergency lighting battery has a capacity of three hours, evacuation of the premises shall be possible within one hour.
66 Emergency lighting tests shall be conducted monthly. Records of these tests shall be made available to the Licensing Authority upon request.
67 A satisfactory NICEIC or ECA periodic electrical installation report shall be provided. The inspection shall be carried out annually and new report shall be provided each year.
68 A satisfactory NICEIC or ECA periodic emergency lighting report shall be provided. The inspection shall be carried out annially and new report shall be provided each year.
69 A certificate by a suitably qualified professional in respect of any suspended ceilings at the premises shall be provided every five years.
70 Confirmation of public liability insurance in the minimum sum of £2 million shall be provided each year.
71 A certificate of inspection for portable fire fighting equipment shall be provided. The inspection shall be carried out annually and a new certificate shall be provided each year.
72 A certificate for inspection for any fire detection alarm at the premises shall be provided. The inspection shall be carried out annually and a new certificate shall be provided each year.
73 A variation of the premises licence shall be sought for any alterations of the premises which would make it impossible to comply with existing licence conditions.
74 Alternative steps to be taken to take the public objective shall be proposed if necessary.
75 A conspicuous notice clearly stating the location of the nearest telephone and the correct method of summoning the fire brigade shall be displayed in the foyer of or in the entrance to the premises.
76 Noise or vibration shall not be audible at the facade of any noise sensitive premises.
77 Sufficient ventilation shall be provided so that doors and windows can be kept closed.
78 Noise limiters shall be fitted to amplification equipment to ensure that noise emission levels can be properly controlled.
79 Prominent, clear and legible notices shall be displayed at all exits requesting patrons to respect the the needs of local residents and to leave to premises and the area quietly.
80 The use of explosives, pyrotechnics and fireworks of a similar nature which coud cause disturbance in surrounding areas shall be restricted.
81 Offensive odours shall not be emitted beyond the boundary of the premises.
82 Flashing or bright lights shall only be placed in positions that do not cause a nuisance to neighbours.
83 The external and internal lobby doors to the premises into Fore Street shall not be restrained in the open position whilst public entertainment events are taking place and shall remain closed at all times other than when patrons are entering or leaving the premises.
84 A proof of age policy agreed by the police and Local Authority shall be enforced.
85 A crime prevention policy agreed by the police and Local Authority shall be in place.
86 An attendant shall be stationed in the area(s) occupied by the children and in the vicinity of each exit.
87 The minimum number of attendants on duty shall be one attendant per 50 children (or part thereof).
88 The supper hours certificate shall be confined to the area (s) hatched in BROWN on the attached plan (s).
89 The additional area to be licensed by variation shall be confined to area outlined in GREEN on the attached plan (s).
90 The sale by retail/consumption of alcohol and regulated entertainment shall be confined to the area (s) as outlined and hatched in RED on the attached plan (s).
