ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1 The times permitted to sell alcohol do not prohibit or restrict the supply to, or consumption by, any person of alcohol in any premises where the premises are bona fide used, or intended to be used, for the purpose of habitually providing for reward, board and lodging, including breakfast and at least one customary main meal.
2 The times permitted to sell alcohol do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.
3 The times permitted to sell alcohol do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
4 The premises may remain open for no more than 90 minutes after the end of the period during which the retail sale of alcohol is permitted, as a “wind-down” period.
5 All bar staff, when recruited, shall be trained on the Licensing Act 2003, particularly in relation to young persons, and a refusals book shall be maintained and kept available for inspection.
6 There shall be no admission for new customers after 2400hrs. Those who leave after that time shall only be re-admitted by the Designated Premises Supervisor (DPS) or a specific Personal Licence-holder designated for that purpose on that day. Details of the reason for re-admission shall be recorded in the refusals book.
7 All amplified music shall be played through the in-house public address system only. No additional amplification equipment (other than media players, pre-amplifiers and sound-mixing equipment) shall be used without prior agreement of the Licensing Officer.
8 Where guests are re-admitted to the premises after 2400hrs, admission shall only be permitted either by the DPS or a specific Personal Licence-holder designated for that purpose on that day. Details of the reason for re-admission shall be recorded in the refusals book.
9 After 23:00 hours, the area outside the front of the premises shall only be used for the purpose of access and egress from the premises. The DPS or Personal Licence-holder designated for that purpose shall take responsiblity for ensuring that the front patio area shall not be used by customers for any other purpose.
10 Children under 16 years of age shall not be permitted on the premises after 21:00 hours unless accompanied by an adult, but the Designated Premises Supervisor shall ensure that staff receive training relating to s.145 of the Licensing Act 2003 and are aware of the obligation to refuse entry to unaccompanied children if the premises becames relevant premises within s.145(4) at any time.
11 All refusals under condition 10 above must be recorded in the Refusals Book.
12 Food shall be available at all times when the premises are open for the serving of alcohol.
13 Amplified music and entertainment shall take place inside the premises only.
14 Noise limiters shall be agreed and set in advance with the Environmental Health Protection Team, indicating a maximum level for amplified music and entertainment, before and after 22:00 hours. After 22:00 hours the level shall be sufficiently low that music is not audible outside the premises. The inaudibility test level shall be set from the current bus stop opposite the premises, at a level agreed with the Environmental Protection Team and also at the boundary of neighbouring properties.
15 All windows shall be closed when licensed entertainment activites take place.
16 The front elevation door shall remain in the closed position except for access and egress when licensed entertainment takes place.
17 Amplified music shall not be played above the regulated levels specified in condition 14 above.
18 No speakers shall be erected in the front patio areas.
19 Signs shall be erected prominently requesting patrons to leave the premises quietly.
20 Background music shall cease on the back patio at 2400hrs. No food or drinks shall be permitted on the back patio after 2400 hrs (effectively a smoking area from 2400hrs).
21 The positioning of the internal speakers to be in accordance with the guidance of the Environmental Health Protection Team.
22 The sale by retail of alcohol shall be confined to the area (s) as outlined in RED on the attached plan (s).
23 Regulated entertainment shall be confined to the area (s) as outlined in BLUE on the attached plan (s).
24 Late night refreshment shall be confined to the area (s) as outlined in GREEN on the attached plan (s).
