ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1 The times permitted to sell alcohol do not prohibit or restrict the supply to, or consumption by, any person of alcohol in any premises where the premises are bona fide used, or intended to be used, for the purpose of habitually providing for reward, board and lodging, including breakfast and at least one customary main meal.
2 The times permitted to sell alcohol do not prohibit or restrict the sale of alcohol to a trader for the purposes of their trade or to a club with a Club Premises Certificate for the purposes of the club.
3 The times permitted to sell alcohol do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.
4 The times permitted to sell alcohol do not prohibit or restrict the taking of alcohol from the premises by a person residing there.
5 The times permitted to sell alcohol do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.
6 The times permitted to sell alcohol do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
7 The times permitted to sell alcohol do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.
8 The times permitted do not prohibit or restrict, during the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel.
9 The premises may remain open for no more than 30 minutes after the end of the period during which the retail sale of alcohol is permitted, as a “wind-down” period.
10 Recorded music shall be reduced to background level during the “wind-down” period. Background music is taken to mean that which is inaudible at the boundary of the premises.
11 Live music shall end at 2300 hours except on New Year's Eve/Day.
12 All bar staff, when recruited, shall be trained on the Licensing Act 2003 and on “drug awareness”.
13 CCTV cameras shall be installed on all exits, to the satisfaction of the Chief Officer of Police. The extension of hours for licensable activities shall not be put into effect until the CCTV apparatus has been successfully installed.
14 There shall be external lighting in all public areas.
15 There shall be a regular collection of glasses and emptying of ashtrays.
16 Fire appliances shall be inspected and if necessary, replaced, on an annual basis.
17 There shall be emergency lighting installed in all public areas.
18 All electrical circuits shall be protected by trip switches approved under IEEC Regulations.
19 Any parties, activities and entertainment taking place on the outside decking area shall cease at 2300 hrs and withdraw indoors. If any amendments to this are to take place, the local residents in the vicinity of the premises this would affect shall be given at least 7 days written notice informing them of the forthcoming events.
20 Recorded music shall end at 0030 hrs, Sunday to Thursday inclusive and 0130 hrs on Fridays and Saturday’s, except on New Years Eve and New Years Day.
21 All windows and doors shall close at 2300 hrs.
22 A notice must be displayed prominently at all exits requesting customers to leave the premises quietly and quickly.
23 Trade deliveries to the premises shall be made only after 08.00 hrs.
24 Kitchen extractor filters shall be cleaned a minimum of once a week to avoid cooking smells affecting the neighbourhood.
25 Photographic proof of age will be required from anyone seeking to purchase alcohol who appears to be under 21 years of age.
26 The cigarette machine shall bear a sign stating ‘No purchases by anyone under 16 years of age’ and be visible from the bar via a mirror.
27 The sale by retail/supply of alcohol, late night refreshment and regulated entertainment will be confined to the area (s) as outlined in BLUE on the attached plan (s).
