• ANNEXE 1 - MANDATORY CONDITIONS

   

  1        There shall be no sale or supply of alcohol when there is no Designated Premises Supervisor (DPS) in respect of this premises licence or at a time when the said Premises Supervisor does not hold a personal licence or when his/her licence is suspended.

   

  2        Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  3        Any person used to carry out a security activity as required under the Annexe 2 conditions must be licensed by the Security Industry Authority.

   

  4        Admission of children (under the age of 18) to any exhibition of films must be restricted in accordance with the film classification body designated as the authority under Section 4 of the Video Recordings Act 1984.

   

  5        Where the film classification is not specified or the relevant licensing authority has notified the premises licence holder under Section 20 (3)(b) of the Licensing Act 2003, the admission of children must be restricted in accordance with any recommendation made by the Licensing Authority.

   

• ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  1        The times permitted to sell alcohol do not prohibit or restrict the supply to, or consumption by, any person of alcohol in any premises where the premises are bona fide used, or intended to be used, for the purpose of habitually providing for reward, board and lodging, including breakfast and at least one customary main meal.

   

  2        The times permitted to sell alcohol do not prohibit or restrict the sale of alcohol to a trader for the purposes of their trade or to a club with a Club Premises Certificate for the purposes of the club.

   

  3        The times permitted to sell alcohol do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.

   

  4        The times permitted to sell alcohol do not prohibit or restrict the taking of alcohol from the premises by a person residing there.

   

  5        The times permitted to sell alcohol do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.

   

  6        The times permitted to sell alcohol do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.

   

  7        The times permitted to sell alcohol do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.

   

  8        The times permitted do not prohibit or restrict, during the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel.

  9        The volume of recorded music shall be turned down to background level during the 30 minute “wind-down” period. Background level is taken to mean that which cannot be heard at the boundary of the premises.

  10    There shall be a regular collection of glasses and emptying of ashtrays.

  11    Trade deliveries to the premises shall be made only after 08.00 hrs.

  12    External lighting shall be supplied and maintained in all public areas.

  13    Emergency lighting shall be installed in all public areas of the premises.

  14    Fire appliances shall be inspected and if necessary, replaced, on an annual basis.

  15    All electrical circuits shall be protected by trip switches approved under IEEC Regulations.

  16    All bar staff, when recruited, shall be trained on the Licensing Act 2003 and on “drug awareness”.

  17    Photographic proof of age will be required from anyone seeking to purchase alcohol who appears to be under 21 years of age.

  18    The cigarette machine shall be sited so as to be in full public view from the bar.

  19    Litter shall be collected from the area around the building at least daily.

  20    Kitchen fans shall be cleaned weekly to prevent cooking smells.

  21    Kitchen fans shall be turned off at 22.00 hours.

  22                  Notices shall be displayed at all exits requesting customers to leave the premises quietly.

  23    The sale by retail/supply of alcohol provision of regulated entertainment and late night refreshment will be confined to the area (s) as outlined in RED on the attached plan (s).

   

   

• ANNEX 3 - CONDITIONS IMPOSED AFTER A HEARING

   

  (1)              The second entrance door fronting Church Street, without a lobby, must be used as a Fire Exit only and not for entry, unless a lobby is fitted.

   

  (2)              Appropriate ventilation measures as specified by or agreed with the Environmental Protection Officer shall be in place by 24th November 2005.

   

  (3)              Live entertainment shall be permitted until 23.00.

   

  (4)              Recorded music, used as background or otherwise, shall be permitted until 00.30.

   

  (5)              The premises may remain open for up to 30 minutes after the end of the period during which the retail of alcohol is permitted, as a “wind-down” period.

   

  (6)              There shall be no entry or re-entry to the premises after 23.00.

   

  (7)              All windows and doors shall remain closed when live or amplified entertainment is taking place.

   

  (8)              Secondary double-glazing shall be fitted to all appropriate windows by the 24th November 2005.

   

  (9)              The placing of speakers for amplified music or other entertainment shall be with the agreement of the Environmental Protection Officer.

   

  (10)              All live music, which shall be limited to three entertainers or less, or amplified entertainment, shall be subject to noise limiters, as agreed with the Environmental Protection Officer.

   

  (11)              Licensable activities or the consumption of alcohol shall be permitted until 22.00 on the patio area, provided that the relevant authorities have granted permission.
