• ANNEXE 1 - MANDATORY CONDITIONS

   

  1        There shall be no sale or supply of alcohol when there is no Designated Premises Supervisor (DPS) in respect of this premises licence or at a time when the said DPS does not hold a personal licence or when his/her licence is suspended. 
   

  2        Every supply of alcohol under the premises licence must be made or authorised
  by a person who holds a personal licence.
   

  3        Any person used to carry out a security activity as required under the Annexe 2 conditions must be licensed by the Security Industry Authority.
   

  4        Admission of children (under the age of 18) to any exhibition of films must be restricted in accordance with the film classification body designated as the authority under Section 4 of the Video Recordings Act 1984.
   

  5        Where the film classification is not specified or the relevant licensing authority has notified the premises licence holder under Section 20 (3)(b) of the Licensing Act 2003, the admission of children must be restricted in accordance with any recommendation made by the Licensing Authority.
   

  6        The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
   

  7        In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-

  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less; (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-

  (i) the outcome of a race, competition or other event or process, or

  (ii) the likelihood of anything occurring or not occurring;

  (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
   

  8        The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
   

  9        The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
   

  FROM 1st OCTOBER 2010
   

  10    The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
   

  11    The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
   

  12    The responsible person shall ensure that-

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

   

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii) still wine in a glass: 125 ml; and

  (b) customers are made aware of the availability of these measures.

   

• ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  1        The times permitted to sell alcohol do not prohibit or restrict the supply to, or consumption by, any person of alcohol in any premises where the premises are bona fide used, or intended to be used, for the purpose of habitually providing for reward, board and lodging, including breakfast and at least one customary main meal.

   

  2        The times permitted to sell alcohol do not prohibit or restrict the sale of alcohol to a trader for the purposes of their trade or to a club with a Club Premises Certificate for the purposes of the club.

   

  3        The times permitted to sell alcohol do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.

   

  4        The times permitted to sell alcohol do not prohibit or restrict the taking of alcohol from the premises by a person residing there.

   

  5        The times permitted to sell alcohol do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.

   

  6        The times permitted to sell alcohol do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.

   

  7        The times permitted to sell alcohol do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.

   

  8        The times permitted do not prohibit or restrict, during the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel.

  9        The volume of recorded music shall be turned down to background level during the 30 minute “wind-down” period. Background level is taken to mean that which cannot be heard at the boundary of the premises.

  10    There shall be a regular collection of glasses and emptying of ashtrays.

  11    Trade deliveries to the premises shall be made only after 08.00 hrs.

  12    External lighting shall be supplied and maintained in all public areas.

  13    Emergency lighting shall be installed in all public areas of the premises.

  14    Fire appliances shall be inspected and if necessary, replaced, on an annual basis.

  15    All electrical circuits shall be protected by trip switches approved under IEEC Regulations.

  16    All bar staff, when recruited, shall be trained on the Licensing Act 2003 and on “drug awareness”.

  17    Photographic proof of age will be required from anyone seeking to purchase alcohol who appears to be under 21 years of age.

  18    The cigarette machine shall be sited so as to be in full public view from the bar.

  19    Litter shall be collected from the area around the building at least daily.

  20    Kitchen fans shall be cleaned weekly to prevent cooking smells.

  21    Kitchen fans shall be turned off at 22.00 hours.

  22                  Notices shall be displayed at all exits requesting customers to leave the premises quietly.

  23    There is to be no regulated entertainment involving amplified music or speech and no other recorded music other than background music.  Background music and speech are defined as activites whose main function is to create an atmosphere rather than to be listened to.  Background music and speech should always be played at a level that would allow conversations between persons in the same room or near to the music source or source of speech without the need for voices to be raised.

  24    The sale by retail of alcohol and late night refreshment shall be confined to the area (s) as outlined in RED on the attached plan (s).

   

   

• ANNEXE 3 - CONDITIONS IMPOSED AFTER A HEARING

   

  1        The second entrance door fronting Church Street, without a lobby, must be used as a Fire Exit only and not for entry, unless a lobby is fitted.
   

  2        Appropriate ventilation measures as specified by or agreed with the Environmental Protection Officer shall be in place by 24th November 2005.
   

  3        The premises may remain open for up to 30 minutes after the end of the period during which the retail of alcohol is permitted, as a "wind-down" period.
   

  4        There shall be no entry or re-entry to the premises after 23:00 hours.  This condition will not apply during the period of the Annual Fair.
   

  5        Licensable activities or the consumption of alcohol shall be permitted until 22:00 hours on the patio area, provided that the relevant authorities have granted permission.
