ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1 The times permitted to sell alcohol do not prohibit or restrict the supply to, or consumption by, any person of alcohol in any premises where the premises are bona fide used, or intended to be used, for the purpose of habitually providing for reward, board and lodging, including breakfast and at least one customary main meal.
2 The times permitted to sell alcohol do not prohibit or restrict the sale of alcohol to a trader for the purposes of their trade or to a club with a Club Premises Certificate for the purposes of the club.
3 The times permitted to sell alcohol do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.
4 The times permitted to sell alcohol do not prohibit or restrict the taking of alcohol from the premises by a person residing there.
5 The times permitted to sell alcohol do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.
6 The times permitted to sell alcohol do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
7 The times permitted to sell alcohol do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.
8 The times permitted do not prohibit or restrict, during the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel.
9 Children are not permitted in the bar area meals and non-alcoholic beverages are available for sale for consumption in that area and, they are in the company of a person aged 18 or over and are there prior to 9 p.m. 1st October to 31st March and 10 p.m. 1st April to 30th September. In such circumstances, they may remain in the specified area for thirty minutes after the certificate has ceased to have effect for the consumption of refreshments.
10 The provision of Regulated Entertainment involving live music, karaoke or amplified music for dancing shall only take place within the Skittle Alley/Function Room.
11 No Regulated Entertainment involving the use of amplified music other than recorded music, as background music, shall be provided on the seating area or any other area external to the building.
12 Automatic door closures will be provided to the Lobby doors from the street into the Lower Bar area and these doors shall not be restrained in the open position at any time.
13 Late night exit (23:00 hours onwards) shall be via the car park side of the premises.
14 Secondary glazing shall be fitted to the East Street lower bar Lobby areas.
15 A decibel cut off meter shall be hardwired into the recorded music and live music band electrical circuit. A mutually agreed maximum Decibel level shall be set between the residents of East Street (as per mediation) and the premises licence-holder.
16 Removable shutters incorporating suitable sound attenuating material shall be affixed internally to windows within the Skittle Alley/Function Room at all times when Regulated Entertainment is taking place within.
17 Secondary acoustic (incorporating wide air gap and thinkened glass) glazing will be provided to 2 No. external windows to the lower bar area.
18 There shall be a policy of no admission or re-admission within 60 minutes of the terminal hour for the sale by retail of alcohol. This fact shall be clearly shown at the public entrances.
19 CCTV shall be in full working order to the satisfaction of the Chief Officer of Police, and shall cover any public exit/entry points.
20 Staff shall be trained on the requirements of the Licensing Act 2003 when they are recruited and on ‘drug-awareness’ as part of their induction.
21 The premises may remain open for no more than 30 minutes after the end of the period during which the retail sale of alcohol is permitted, as a “wind-down” period.
22 External lighting shall be operational at all times in public areas.
23 There shall be an anual electrical safety check by a qualified NICEIC engineer.
24 Emergency lighting shall be operational at all times throughout the premises.
25 All electrical circuits shall be controlled by over current trips.
26 The lower bar area shall be non-smoking at all times.
27 There shall be a regular collection of glassware and ashtrays both inside and outside the premises.
28 All fire appliances shall have an annual maintenance check by a suitably qualified person, and if necessary shall be replaced.
29 There shall be a fire blanket in the Kitchen.
30 Recorded music shall be reduced to background level during the ‘wind-down’ period.
31 A notice shall be displayed prominently at all public exits requesting customers to leave the premises quietly.
32 Kitchen extraction filters shall be cleaned at least once a week and they shall be turned off no later than 22:30 hours.
33 Deliveries to the premises shall NOT be made before 07:00 hours.
34 Photographic proof of age shall be required from anyone seeking to purchase alcohol who appears to be under 21 years of age. This shall only include ‘Prove it cards’, Driving Licenses or Passports.
35 The cigarette machine shall be in full view of the bar.
36 Gaming machines shall be in full view of the bar.
37 Adult entertainment (over 18 years old) shall take place in an area suitably isolated from all under 18 year olds.
38 The sale by retail/supply of alcohol and regulated entertainment shall be confined to the area (s) as outlined in RED on the attached plan (s).
