ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1 The times permitted to sell alcohol do not prohibit or restrict the supply to, or consumption by, any person of alcohol in any premises where the premises are bona fide used, or intended to be used, for the purpose of habitually providing for reward, board and lodging, including breakfast and at least one customary main meal.
2 The times permitted to sell alcohol do not prohibit or restrict the sale of alcohol to a trader for the purposes of their trade or to a club with a Club Premises Certificate for the purposes of the club.
3 The times permitted to sell alcohol do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.
4 The times permitted to sell alcohol do not prohibit or restrict the taking of alcohol from the premises by a person residing there.
5 The times permitted to sell alcohol do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.
6 The times permitted to sell alcohol do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
7 The times permitted to sell alcohol do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.
8 The times permitted do not prohibit or restrict, during the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel.
9 When staff are recruited, they shall be trained on the requirements of the Licensing Act 2003 and on ‘drug-awareness’.
10 The premises may remain open for up to 60 minutes after the end of the period during which the retail of alcohol is permitted, as a ‘wind-down’ period.
11 Recorded music shall be reduced to background level during the ‘wind-down’ period.
12 There shall be a regular collection of glasses and emptying of ashtrays.
13 No glasses shall be removed from inside the premises except when the beer garden is in use.
14 Fire appliances shall be inspected and replaced, if necessary, on an annual basis.
15 All electrical circuits shall be protected by trip switches approved under IEEC Regulations.
16 A notice will be prominently displayed at the exits asking customers to leave quietly.
17 Trade deliveries to the premises shall be made only after 0700 hrs.
18 Photographic proof of age will be required from anyone seeking to purchase alcohol who appears to be under 21 years of age.
19 The cigarette machine shall be sited so as to be in full public view from the bar.
20 In the event of a stripper gram being invited in by customers, all persons under the age of 18 years shall be encouraged to leave the premises unless the performance is in the function room away from such persons.
21 There shall be a working CCTV system in place.
22 Door stewards to the ratio of 1 per 75 patrons shall be employed when there is live music that will attract an under 25 years customer base.
23 Any live music in the beer garden shall be limited to a maximum of four players/artists playing low level amplified acoustic/wind instruments and singing.
24 The instruments to be piano, guitar, flute and banjo.
25 Noise levels shall be monitored and consultation with neighbours shall be ongoing.
26 There shall be a regular collection of empty glasses and bottles.
27 Windows shall be kept closed after 2200 hrs.
28 The beer garden shall be vacated by 2300 hrs, except for seasonal variations.
29 Under 16’s to vacate general trade areas by 2000 hrs unless eating with over 18’s.
30 The sale by retail of alcohol shall be confined to the area (s) as outlined in RED on the attached plan (s).
31 Regulated entertainment shall be confined to the area (s) as outlined in YELLOW on the attached plan (s).
32 Late night refreshment shall be confined to the area (s) as outlined in GREEN on the attached plan (s).
