ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. This Licence shall be limited to only one chosen Friday, Saturday and Sunday in the month of June annually.
2. Door Supervisors will be correctly registered with the SIA.
3. They will display the correct name badge.
4. They will carry proof of registration.
5. Security cover will be provided to the level that is pre agreed by the local police and goldcoast oceanfest organisers to give the public a safe event and security staff a safe working environment, as based on previous experience.
6. A female supervisor will be available if searches are to be conducted on female customers.
7. Door Supervisors will wear a uniform that is clearly visible and all uniform that is worn is individually numbered and logged before each shift.
8. Door Supervisors will be in attendance at the entrance of the premises as per the opening hours; and in attendance at the entrance to the bar as per the opening hours specified for the supply of alcohol.
9. Glass bottles are used in the bar area, the contents will be decanted into plastic or toughened glass when exiting the designated bar area.
10. No customers carrying open or sealed bottles or glasses will be admitted to the premises at any time.
11. No customers will be permitted to take open containers of alcoholic drinks from the premises.
12. All bottles and glasses will be removed from public areas as soon as possible once they are finished with or empty.
13. Radios will be used in the licensed premises to provide two way communication between the SIA STAFF, STEWARDS & DPS on the licensed premises.
14. The equipment will be kept in working order at all times.
15. The equipment will be on at all times the premises are open to the public, and will be monitored by a nominated responsible staff member.
16. All instances of crime and disorder will be reported to the police in person, with mobile phone or radio.
17. Any reasonable police requirements will be complied with at all times.
18. Consideration will be given to setting capacity limits to prevent overcrowding which could lead to crime and disorder.
19. This capacity figure will be agreed with the Police, Fire or local authority.
20. Door supervisors will be present to ensure the capacity limits are monitored.
21. A proof of age policy to the satisfaction of the police and the Local Authority will be in place. Acceptable proof may be regarded as a credit card, drivers licence, passport or similar methods of recognised proof.
22. All-inclusive nights or other irresponsible drinks promotions will not be permitted.
23. An anti drug policy agreed by the Police and local authority will be in force.
24. A person holding the National Licensees Certificate will be on or in the vicinity of the premises and be immediately contactable by radio or mobile phone at all times when alcohol is being served or regulated entertainment provided.
25. Substantial and reasonably priced food will be available at all times the premises are open.
26. A log and record details of all instances of public disorder and complaint will be kept.
27. Means of escape will be maintained unobstructed, immediately available and clearly identifiable.
28. Step and stair edges will be highlighted so as to be conspicuous.
29. Access will be provided for emergency vehicles and this access will be kept clear and free from obstruction.
30. All fire exits and means of escape will be signed in accordance with BS5499.
31. An evacuation policy will be in place that is to the satisfaction of the Fire Authority. All staff members will be trained in the evacuation policy.
32. The fire brigade will be called to any outbreak of fire, however slight.
33. Stage fabrics will be fire resistant.
34. Exit gates will open outwards (or will be secured in the open position).
35. When disabled people are present, adequate arrangements will exist to enable their safe evacuation in the event of an emergency.
36. Adequate and appropriate supply of first aid equipment and materials will be available on the premises.
37. At least one suitable trained first aider will be on duty when the public are present.
38. If more than one first aider is present, their respective duties will be clearly defined.
39. The first aider will be trained to deal with drug and alcohol related problems.
40. In the absence of adequate daylight, the lighting in any area accessible to the public will be fully operational.
41. Fire safety signs will be adequately illuminated.
42. Emergency lighting tests will be conducted monthly. Records of these tests will be made available to the Licensing Authority upon request.
43. Confirmation of public liability insurance in the minimum sum of £2 million must be provided. A new certificate will be provided each year.
44. A certificate of inspection for portable fire fighting equipment must be provided. The inspection will be carried out annually and a new certificate provided each year.
45. Where a temporary electrical installation is being used, a temporary electrical installation report complying with BS7909 will be provided.
46. The use of special effects or mechanical installation will be arranged and stored so as to minimise any risk to the safety of the audience, performers and staff.
47. Special effects including the following will only be used with prior notification to the Licensing and/or
Fire authorities:-
Dry ice machines and cryogenic fog;
Smoke machines and fog generators;
Real flame;
Strobe lighting.
48. Free drinking water will be made available at all times the premises is open to the public.
49. A hot line to a local taxi firm and other local public services will be available in the local programme.
50. Searching as a condition of entry will be considered at all times and will be mandatory when directed by police.
51. Overcrowding will not be allowed in any part of the premises.
52. Where tables and chairs are provided, clear gangways to exits will be maintained.
53. Portable heating appliances will be monitored.
54. Appliances utilising cylinders or containers of gas will be used on the premises.
55. The premises will be adequately ventilated in all areas to which the staff and public have access.
56. An Info point for lost persons and property and a designated meeting point for the public shall be provided.
57. Prominent, clear and audible public announcements will be made at the end of each evening requesting patrons to respect the needs of local residents and to leave the premises and the area quietly.
58. The playing of live music on the premises will not be permitted after the specified time of 11.00 pm.
59. In order to reduce the likelihood of a mass exodus, films etc. will be shown on the screen for an additional hour but any sound track will be inaudible at the residential properties to the east of the site.
60. A constantly manned telephone number will be given to the Environmental Health Department of North Devon District Council.
61. Sound levels will be monitored at the mixer desk for the Saturday live bands with the aim of ensuring that the levels do not exceed 95 dB, measured as an LAeq,1min.
62. There will not be any organised firework displays.
63. Where music needs to be played outside the permitted hours for sound checking, the initial system check will be restricted to between 4.00 pm and 6.00 pm on the Thursday evening unless delayed due to inclement weather and a live band sound check restricted to between 9:00 am and 10.00 am on Saturday.
64. Any sound tracks to video clips etc. for the last 30 mins (i.e. 11.00 pm to 11.30 pm Friday, Saturday and 9.30 pm to 10.00 pm Sunday) will be inaudible at the residential properties to the east of the site.
65. A sufficient number of suitable receptacles for refuse storage will be provided. These will have properly fitted covers.
66. The receptacles will be maintained in a clean condition.
67. A proof of age policy agreed by the police and local authority will be enforced.
68. When films are classified by the film classification body, they will be classified in the following way:-
U - Universal - suitable for audiences aged 4 years and over;
PG - Parental Guidance - some scenes may be unsuitable for young children;
12A - viewing by persons aged 12 years or older or persons younger than 12 when accompanied by an adult;
15 - viewing by persons aged 15 years and over;
18 - viewing by persons aged 18 years and over;
69. The backstage facilities will be large enough to accommodate safely the number of children taking part in any performance.
70. All chaperones and production crew on the show will receive instruction on the fire procedures prior to the arrival of the children.
71. Special effects, including smoke, dry ice, rapid pulsating or flashing lights, should not be used in such performances.
72. Children performing in productions will be kept under adult supervision at all times.
73. Children will be accounted for at all times in case of an evacuation or emergency.
74. Arrangements for children in performances and attendance’s in general on the Education day will be co-ordinated by the DCC schools representative/s.
75. The sale by retail of alcohol, regulated entertainment and late night refreshment shall be confined to the area coloured yellow on the attached plan (s).
