• ANNEXE 1 - MANDATORY CONDITIONS

   

  1        There shall be no sale or supply of alcohol when there is no Designated Premises Supervisor (DPS) in respect of this premises licence or at a time when the said DPS does not hold a personal licence or when his/her licence is suspended. 
   

  2        Every supply of alcohol under the premises licence must be made or authorised
  by a person who holds a personal licence.
   

  3        Admission of children (under the age of 18) to any exhibition of films must be restricted in accordance with the film classification body designated as the authority under Section 4 of the Video Recordings Act 1984.
   

  4        Where the film classification is not specified or the relevant licensing authority has notified the premises licence holder under Section 20 (3)(b) of the Licensing Act 2003, the admission of children must be restricted in accordance with any recommendation made by the Licensing Authority.
   

  5        The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
   

  6        In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-

  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less; (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-

  (i) the outcome of a race, competition or other event or process, or

  (ii) the likelihood of anything occurring or not occurring;

  (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
   

  7        The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
   

  8        The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

  9        The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
   

  10    The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
   

  11    The responsible person shall ensure that-

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

   

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii) still wine in a glass: 125 ml; and

  (b) customers are made aware of the availability of these measures.

   

• ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  1        A responsible duty manager shall be on duty at all times and carry a radio.
   

  2        At least 2 fire marshals shall be on duty at all times and carry radios.
   

  3        The reception shall have a radio.
   

  4        A proof of age policy shall be in place.
   

  5        All children’s names and ages shall be recorded prior to guest arrival.
   

  6        All guests are required to wear name badges.
   

  7        All exit doors shall be easily openable without the use of a key, card, code or similar means and shall be available for egress while the public are on the premises.
   

  8        Means of escape shall be maintained unobstructed, immediately available and clearly identifiable.
   

  9        Exit doors shall be regularly checked to ensure they function satisfactorily.
   

  10    All fire doors shall be maintained effectively self closing and shall not be held open in unoccupied areas.
   

  11    Fire resisting doors to service shafts, ducts and cupboards shall be kept locked shut.
   

  12    Steps and stair edges shall be highlighted so as to be conspicuous.
   

  13    All gangways, exit ways and treads of steps shall be maintained with non-slippery and even surfaces.
   

  14    All floor coverings shall be secured and maintained so that they will not ruck. Mats shall be fitted into mat wells so as to be flush with the floor surface.
   

  15    Upholstered seating shall be fire retardant and compliant with current fire safety regulations.
   

  16    Notices dealing with the actions to be taken en the event of a fire or other emergency shall be prominently displayed and maintained in a good condition.
   

  17    Access shall be provided for emergency vehicles and this access shall be kept clear and free from obstruction.
   

  18    Fire drills shall be conducted twice yearly and lighting tests every three months. Records of these tests shall be made available to the Licensing  Authority upon request.
   

  19    All fire exits and means of escape shall be signed in accordance with BS5499.
   

  20    An evacuation policy shall be in place and all staff members shall be trained in the evacuation policy.
   

  21    The fire brigade shall be called to any outbreak of fire, however slight.
   

  22    Exit doors shall open outwards (or be secured in the open position).
   

  23    When disabled people are present, adequate arrangements shall exist to enable their safe evacuation in the event of an emergency.
   

  24    Disabled people on the premises shall be made aware of these arrangements.
   

  25    Adequate and appropriate supplies of first aid equipment and materials shall be available on the premises.
   

  26    At least one suitably trained first aider shall be on duty when the public are present.
   

  27    In the absence of adequate daylight, the lighting in any area accessible to the public shall be fully operational.
   

  28    Fire safety signs shall be adequately illuminated.
   

  29    Emergency lighting shall not be altered.
   

  30    Emergency lighting batteries shall be fully charged before admission of the public.
   

  31    In the event of failure of normal lighting, evacuation of the premises shall be possible in less than 20 minutes.
   

  32    Emergency lighting tests shall be conducted every 3 months. Records of these tests shall be made available to the Licensing Authority upon request.
   

  33    A satisfactory NICEIC periodic electrical installation report shall be provided. The inspection shall be carried out every 5 years and the certificate shall be made available to the Licensing Authority on request.
   

  34    A satisfactory NICEIC periodic emergency lighting report shall be provided. The inspection shall be carried out every 3 months and the report shall be made available to the Licensing Authority on request.
   

  35    A Gas Safe certificate of inspection shall be provided in respect of any gas boiler. The inspection shall be carried out yearly and the certificate shall be made available to the Licensing  Authority on request.
   

  36    An OFTEC certificate of inspection in respect of any oil-fired boiler shall be provided. The inspection shall be carried out yearly and the certificate shall be made available to the Licensing Authority on request.
   

  37    Confirmation of public liability insurance to the minimum of £2 million shall be provided. A new certificate shall be provided each year.
   

  38    A variation of the premises licence shall be sought for any alteration to the premises which would make it impossible to comply with an existing licence condition.
   

  39    With a seating capacity of less than 160 people, there will always be at least two attendants present.
   

  40    Attendants will not be engaged in any duties that would hinder the prompt discharge of their duties in the event of an emergency or entail their absence from the auditorium where they are on duty.
   

  41    Attendants shall be badged and readily identifiable to the audience.
   

  42    The premises will not be used for closely seated audience except in accordance with seating plans.
   

  43    Doors and windows shall be kept closed whenever necessary.
   

  44    The playing of live or recorded music in the grounds of the premises shall not be permitted after 2200hrs.
   

  45    Bright lights on or outside the premises shall not cause a nuisance to nearby properties.
   

  46    Lee Abbey shall follow the Diocese of Exeter guidelines on the safe guarding of children and vulnerable adults.
   

  47    All employees are required to obtain a CRB disclosure.
   

  48    When films are classified by the film classification body, they will be classified in the following way:-  U Universal, suitable for audiences aged 4 years and over; PG Parental Guidance, some scenes may be unsuitable for young children; 12A, viewing by persons aged 12 years or older or persons younger than 12 when accompanied by an adult; 15, viewing by persons aged 15 years and over; 18, viewing by persons aged 18 years and over.
   

  49    When a film is to be shown, notices shall be given so that persons are aware of the classification.
   

  50    The sale by retail of alcohol shall be confined to the area (s) as outlined in PINK on the attached plan (s).
   

  51    Regulated entertainment shall be confined to the area (s) as outlined in BLUE on the attached plan (s).
   

  52    Late night refreshment shall be confined to the area (s) as outlined in ORANGE on the attached plan (s).
