• ANNEXE 1 - MANDATORY CONDITIONS

   

  1        There shall be no sale or supply of alcohol when there is no Designated Premises Supervisor (DPS) in respect of this premises licence or at a time when the said DPS does not hold a personal licence or when his/her licence is suspended. 

   

  2        Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
   

  3        Admission of children (under the age of 18) to any exhibition of films must be restricted in accordance with the film classification body designated as the authority under Section 4 of the Video Recordings Act 1984.
   

  4        Where the film classification is not specified or the relevant licensing authority has notified the premises licence holder under Section 20 (3)(b) of the Licensing Act 2003, the admission of children must be restricted in accordance with any recommendation made by the Licensing Authority.
   

  5        The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
   

  6        In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-

  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less; (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-

  (i) the outcome of a race, competition or other event or process, or

  (ii) the likelihood of anything occurring or not occurring;

  (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
   

  7        The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
   

  8        The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
   

  9        The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
   

  10    The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
   

  11    The responsible person shall ensure that-

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

   

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii) still wine in a glass: 125 ml; and

  (b) customers are made aware of the availability of these measures.

   

  WITH EFFECT FROM 6 APRIL 2014

   

  12    A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

   

• ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  1        Adequate training will be provided to bar staff to ensure compliance with the law, training to include consumption of alcohol by persons less than 21 years of age and the prevention of adults buying alcohol for children, all staff training to be documented.
   

  2        Staff training to include understanding the social responsibilities associated with the sale and supply of intoxicating liquor.
   

  3        An entry and exit policy to be introduced to include proof of age, responsible management of group admissions which may include stag or hen parties and non admission to persons who are drunk and/or disorderly or are identified as “excluded”.
   

  4        Measures to promote sensible drinking will operate including commitment not to participate in “two drinks for one offers” and ”happy hour” promotions.
   

  5        Appropriate levels of exterior lighting to be provided to discourage disorder, whilst minimizing impact on neighbouring properties.
   

  6        All empty bottles to be deposited securely into containers at times that will cause minimum disturbance to residents.
   

  7        A full risk assessment appropriate for the proposed operation to be carried out on the premises and individual separate risk assessments undertaken for the kitchen area and the bar area.
   

  8        Provision of procedures for the contact of the emergency services in the event of a emergency to be put in place and staff to be trained in evacuation procedures at all times whilst the premises are in use.
   

  9        Adequate and appropriate lighting inside the premises will be put in place.
   

  10    The provision of appropriate ventilation systems to be put in place and maintained.
   

  11    Noise assessments to be undertaken to identify measures required to prevent nuisance.
   

  12    Door and windows to be kept closed to control sources of noise disturbance.
   

  13    Measures will operate including providing signage or announcements to ensure customers exit the premises quietly to minimise disturbance to residents in the area.
   

  14    A zero tolerance policy will operate towards persons who are persistently rowdy when leaving the premises.
   

  15    A winding down period shall be operated in the premise which would include reducing levels of music or introducing more soothing music together with the stopping of alcohol sales, changing lighting levels and promoting the sale of food and non-alcoholic beverages.
   

  16    Ensure adequate and appropriate first aid equipment and materials are available on the premises together with sufficient trained first aiders.
   

  17    CCTV will be installed and working to the satisfaction of the Police and Local Authority.
   

  18    Recording will be maintained and kept for a minimum of 28 days.  If the CCTV equipment is inoperative, the Police and Local Authority must be informed as soon as possible and immediate steps will be taken to put the equipment back in action.
   

  19    A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
   

  20    No customers carrying open or sealed bottles or glasses will be admitted to the premises at any time.
   

  21    No customers will be permitted to take open containers of alcoholic or soft drinks from the premises.
   

  22    All bottles and glasses will be removed from public areas as soon as they are finished with or empty.
   

  23    Consideration will be given to setting capacity limits to prevent overcrowding which could lead to crime and disorder.
   

  24    This capacity figure will be based on advice from the Police, Fire or Local Authority.
   

  25    Doors supervisors may be required to ensure the capacity limits are controlled.
   

  26    Persons under the age of 18 will not be allowed on the premises after 22:00 hrs.
   

  27    A proof of age policy will operate where persons will be challenged for proof of age where that person appears to look under the age of 21 years of age.
   

  28    Children under the age of 18 will not be admitted unless accompanied by an adult whilst dining.
   

  29    The primary use of the premises shall be that of a Restaurant/Wine bar and alcohol shall remain ancillary to that purpose.
   

  30    The supply of alcohol, regulated entertainment and late night refreshment shall be confined to the area (s) as outlined in RED on the attached plan (s).
